Rajasthan Service Rules (RSR) General Introduction

rule 1:- Under Article 309 of the Indian Constitution, every state has the right to make certain rules and provisions for the operation of government services in its state.

> >On the basis of notification dated 23 March 1951 Rajasthan Service Rules (R.S.R.) came into effect in Rajasthan from 01.04.1951.

>> RSR rules are executive orders of the Governor and apply to all employees of Rajasthan.

Rajasthan Service Rules (RSR)Exceptions to which Rajasthan Service Rules do not apply:

1. Central Government employees appointed in Rajasthan.

2. If any employee, who is from any other service but is working under Government on deputation basis. Is appointed in.

3. Chairman and members of Rajasthan Public Service Commission.

4. Judge appointed in Rajasthan High Court.

5. Those employees whose payment in adverse circumstances is made from the contingency fund. Contingency Fund is maintained under Article 267(2) of the Indian Constitution.

6. Consolidated Fund is maintained under Article 266 (1) of the Indian Constitution.

Rule 7:- Definitions:

Rule 7(1):- Age:- Age means the day from which the employee is promoted or demoted or retired from his post and this day will be considered as his non-working day.

Rule 7(2):- Learner:- This means that in RSR, that employee is appointed on the basis of monthly salary to some extent as against permanent post.

Rule 7(3):- Constitution:- The law adopted by the Indian Parliament on 26.11.1949 is called the Constitution.

Rule 7(4):- Cadre:- The class representing a permanent post is called cadre.

Rule 7(4) (a):- Class IV Service:- Employees holding Grade Pay 1700 – 1800 in RSR.

Rule 7(5):- Compensatory Allowances:- Such allowances which are initially paid by the employee himself and then compensated by the government to the employee.

Rule 7(6):- Competent Authorities:- All employees covered under Appendix 9 Part 2, who can exercise financial powers.

Rule 7(7):- Consolidated Fund:- Fund set up under Article 266(1) of the Indian Constitution.

Rule 7(7) (a):- Commuted Leave:- Half pay leaves covered under Rule 93 can be converted into commuted leave.

Rule 7(8):- Duties:- This means an employee doing government service. The probationary period and the period of holidays always come under duty.

Rule 7(6) (b):- In India itself, if an employee is sent on training then it is considered to be on duty.

Rule 7(8) (c):- The period of APO is considered as on duty. Rule 7(8) (d):- If, with the permission of the competent authority, he appears in any departmental examination, passing of which will increase his work efficiency, then such period is the period of duty.

Rule 7(9):- Fee:- Income received from funds other than the Consolidated Fund is called fee. Note:- Payment received under Rule 64 is fee.

Rule 7(10):- Foreign Service:- Such service in which the employee receives payment from local fund instead of consolidated fund is called foreign service.

Rule 7(10) (a):- Gazetted Officer:- All the officers covered under Section 1 of Classification Control Appeal Rules 1958 are Gazetted Officers.

Rule 7(10)(b):-Half-pay:- Half-pay means leave given under Rule 93.

Rule 7(11):- Head of Department:- All the officers covered under Appendix 14 Part 2 are heads of departments.

Rule 7(12):- Public Holidays:- Such holidays are given by the government i.e. such holidays which are declared by the government on the basis of any notification.

Rule 7(13):- Honorarium:- Honorarium is always payable to a government employee for doing any occasional work.

Rule 7(14):- Time of assuming office:- Under the 1981 rules, the time given to an employee when he is transferred from one place to another is called joining time.

Rule 7(15):- Holidays:- Leave taken by the employee from his own account.

Rule 7(16):- Leave Salary:- Salary is payable according to the nature of leave taken by the employee. (Rule 97)

Rule 7(17):- Tenure:- When an employee is appointed permanently to a permanent post, he has tenure on that post.

Rule 7(18):- Local Fund:- The fund determined under Article 268(2) of the Indian Constitution is called Local Fund.

Rule 7(19):- Ministerial employees:- The employees covered under Appendix 12 are ministerial employees. (Clerical Category) Rule 7(20):- Month:- Month means a unit of calendar year.

Rule 7(21):- Deleted on 01.01.1995.

Rule 7(22):- Permanent Employee:- This means an employee holding permanent position on his post in RSR.

Rule 7(23):- Substitute:- This refers to those employees who are given the responsibility of additional post along with their post.

Rule 7(24):- Salary:- Salary refers to the monthly amount received by a government employee in RSR.

Rule 7(25):- Pension:- Monthly amount to be paid to employees after retirement by the government.

Rule 7(26):- Permanent post:- Such posts for which no time limit is prescribed in RSR.

Rule 7(27):- Personal Pay:- If for some reason there is a cut in the pay series of a government employee and the benefit of that cut is given again for a certain time limit, it is called personal pay.

Rule 7(28):- Earned Leave:– Leave earned on the basis of time spent in service comes under the category of earned leave. (Under Rule 91)

Rule 7(29):- Notional salary of the post:- Such salary is always payable only when the employee is assigned the authority of any additional post other than his own post. The right to give or not to pay such salary is always based on the recommendation of the Finance Department.

Rule 7(30):- Probationary:- After date 20.01.20006, no appointment is made to any such post by Rajasthan Government. Fixed salary is payable to such employee.

Rule 7(30)(a):- Probationary Trainee:- After 20.01.2006, temporary appointment is made on permanent post for two years.

Rule 7(31):- Special Pay:- If a government employee achieves any special achievement while in service, he is paid a special salary on the advice of the Finance Department.

Rule 7(32):- Higher Service:- In RSR, all services except Class IV service are higher services.

Rule 7(33):- Subsistence grant:- The monthly grant paid by the government to an employee when the employee is suspended is called subsistence grant.

Rule 7(34):- Basic Pay:- After the grade pay is added to the employee’s pay series, his basic pay is determined.

Rule 7(35):- Permanent appointment:- An appointment in which the employee holding the position holds a fixed position.

Rule 7(36):- Term posts:- Generally, such posts are created for a fixed period and the tenure of the employee working on them remains attached to that post.

Rule 7(37):- Time Pay Scale:- The pay series of an employee’s time pay scale always moves from lower level to higher level.

Rule 7(38):- Transfer:- This means appointing an employee from one place to another.

Rule 7(39):- Sabbatical Department:- Such departments in which the headquarters remain closed for a certain period. Like Judicial Department, Education Department, Agriculture Department.

Rule 7(40):- Institutions ineligible for pension:- The salary and allowances of such employees are determined from sources other than the government budget.
